خضعت سوريا إلى نظام استبدادي، شمولي، قمعي منذ ما يقرب من خمسين عاماً، فأوقع البلاد في فساد وإفساد كبيرين من غير رادع من قانون أو تشريع، الأمر الذي أدى إلى اندلاع الثورة الشبابية السورية رداً على ما قام ويقوم به النظام من قمع واضطهاد، واستباحة للحريات والكرامات وتم تغييب الشعب عن صنع مصيره وإقامة دولته المدنية التي تحفظ للمواطنين حقوقهم وكرامتهم، وتصون أمنهم في ظل نظام يؤسس لحقوق الإنسان في الحرية والحياة الكريمة. وقد أدى الحراك الشعبي الذي انطلق في كافة أرجاء الوطن إلى صدور العديد من المبادرات الوطنية، التي تبحث كلها عن حل لأزمة البلاد التي أدخلتها في نفق لا يعلم أحد ما نتائجه، في ظل نظام لا يقبل سوى الحلول الأمنية والعسكرية لإنهاء الثورة.
ومن دراسة جميع هذه المبادرات فقد رأى الموقعون على هذه الوثيقة استنتاج خلاصة من هذه الطروحات، التي انتشرت في الشارع السوري، تحدِّد رؤية مستقبل البلاد في ضوء ما يجري على الساحة السورية.
تهدف هذه الوثيقة إلى وضع المبادئ العامة لرؤية مستقبلية للخروج من الأزمة الراهنة، عبر مرحلة انتقالية، يتوافق عليها السوريون، ويفرضها الحراك الشعبي، تقودها حكومة إنقاذ وطني تؤسس لدستور جديد، لتشكيل الدولة المدنية العصرية، وسنِّ القوانين اللازمة لذلك، وإجراء انتخابات نيابية ورئاسية، خلال فترة محددة وفق ما يأتي:
1- تكمن رؤيتنا لسورية المستقبل في دولة مدنية تعددية ديمقراطية يتشارك فيها السوريون على قدم المساواة ضمن مفهوم المواطنة المدنية، ودولة الحق والقانون والمؤسسات.
2- يحرص الموقعون على هذه الوثيقة على حماية السلم الأهلي، وتعزيز ثقافة التسامح والعيش المشترك، واحترام خصوصيات كل مكونات المجتمع السوري وثقافاتهم وحقوقهم، في إطار المواطنة المدنية، وقيم العدل والمساواة واحترام حقوق الإنسان.
3- يدعو الموقعون على هذه الوثيقة إلى تشكيل سلطة تنفيذية منتخبة ديمقراطياً، تهدف إلى تشكيل حكومة إنقاذ وطني تضم وزراء (مستقلين) يمثلون كافة مكونات المجتمع السوري والقادة الشباب الذين يقودون الثورة السورية؛ من أجل الانتقال بالبلاد من الدولة الأمنية إلى الدولة المدنية، وتؤسس لإعادة تشكيل الأجهزة الأمنية، وتحديد مسؤولياتها، وبنائها على أساس احترام المواطن وحقوق الإنسان، وأن تخضع للمساءلة أمام السلطة القضائية، وكذلك إنهاء اختطاف الدولة من السلطة القائمة، من أجل التأسيس لدولة ديمقراطية مدنية حديثة تصون وتحترم الشرائع والمواثيق الدولية، وتؤسس لعلاقات متوازنة على قاعدة الاحترام المتبادل مع جميع الدول في المجتمعين الإقليمي والدولي .
ملاحظة : الوثيقة معروضة لانضمام وتأييد كل الفعاليات والأطر الوطنية والشخصيات العامة حتى لحظة المؤتمر، وهي مطروحة للنقاش في المؤتمر, وسيتم تحديد زمان ومكان انعقاد المؤتمر خلال اليومين القادمين,

Through public letter to UN and prosecutor General of the international criminal court

two months ago we have submitted issue in front of the prosecutor General of the international criminal court, That based to the Rome statute article 15/1, asking him begin investigation related to the massacres occurred by Syrian regime against Syrian civilian population,

Where the court has sent us, they had been registered the case, and sent us reference number. (The court reference no.)

Where, today the number of dead reached up to 1100 civilian persons, included more than 25 children,

But, unfortunately, the UN, and international criminal court, still happy to watch this massacres,

Therefore, we wonder

 If there is still a conscience, in the hearts of those officials at the judicial institutions of the United Nations,

Legally, the case has been submitted based on the following legal articles and elements:

  Article 5.b; Crimes against humanity Rome statute,

And the principles of the international humanitarian law “IHL",

- (GC IV, Art.32 ` AP I 75) prohibition of murder, torture, corporal punishment, rape.

- (GC IV, Art, 34 ` AP I 75) prohibition of taking hostages.

- (GC IV, AP I Art 75) Abusive Judiciary, internment or detention Procedure

- (OT, Art 49. GC IV) Deportation

- (GC IV, Art 49) inhuman treatment

- (GC IV, Art 51) indiscriminate attacks

- (GC IV, Art 51) Acts or violence to spread terror

- (GC IV, Art 33) Pillage is prohibited

- (IAC: Art.64, GC IV) Judicial guarantees

- (Art.77.2, AP I) (Art.4.3, AP II) Children: take part in hostilities.

But, unfortunately, the UN, and international criminal court, still happy in this massacres

Group of the Progressive Alliance of Socialists & Democrats in the European Parliament condemns the systematic killing by Syrian Regime

S&D Euro MP Richard Howitt today called for worldwide attention to continuing systematic killing of democracy protesters in Syria, to coincide with today's European Parliament debate in the continuing uprisings across the Arab world.

Mr Howitt, S&D spokesperson on the issue, welcomed a leading Syrian human rights defender to Strasbourg to hear first hand how the regime in Damascus is deliberately suppressing information about arrests and violence against protesters which started on March 15th.

Iyas Maleh, Director of the Haitham Maleh Foundation said that 100,000 had taken part in democracy protests and that 10-20 people were being killed by security forces on a daily basis.

Socialists and Democrats in the European Parliament heard that human rights activists including those who express concern through social media are being targeted.

 

Mr Howitt said: "Europe must step efforts to enable international human rights monitors and independent journalists to gain access to Syria, and to reiterate there must be full accountability for all responsible for violations of human rights."
